First: Terms of Use

These terms govern your use of our website abayti.app (the “Website”) and our mobile applications “Abayti” and “Abayti Seller” (the “Application”). The Website and Applications are collectively referred to as the “Platform”.

Please read these terms carefully before using the Platform. By using the Platform or its Applications, you agree to be bound by these terms. If you do not agree to any of these terms, please do not use the Platform or delete the Application.

Eligibility to Use

  • The user must be at least 18 years old.

  • Commercial entities (companies or institutions) must be officially licensed.

Use of the Platform and Services

  • All commercial agreements, such as pricing, taxes, shipping costs, and payment methods, are made solely between the seller and the buyer.

  • The Platform acts only as an intermediary and assumes no obligations arising from the agreement between the two parties.

  • The Platform is not responsible for the quality of products, their conformity with the description, or the customer’s satisfaction.

  • The merchant is solely responsible for all images and data related to their products.

  • The merchant must temporarily close the store if unable to manage it; otherwise, the Platform may automatically close it temporarily.

  • Unavailable products must be removed from the store immediately.

Personal Information

When registering as a user (merchant, buyer, or delivery representative), you are required to provide personal identification details, contact information, location data, and banking information (for merchants only).

For buyers, payment information may be required when using electronic payment methods. The Platform commits not to share payment data with any third party except for fraud verification or legal compliance purposes.

The Platform is not responsible for any unauthorized use of payment cards, and the user is responsible for securing their own data.

Delivery

  • Delivery times are estimates and may vary depending on the seller’s circumstances or the region.

  • Users must provide a correct and accurate delivery address; if changed, the order may be canceled without a refund.

  • If delivery fails due to an error or negligence by the buyer, the goods shall be deemed delivered.

Prohibited Activities (Merchants Only)

  • Using the Platform for unlawful purposes.

  • Publishing content that infringes intellectual property rights or privacy.

  • Publishing offensive, obscene, harassing, or inciting content.

  • Publishing personal information, phone numbers, or addresses without permission.

  • Impersonating others or collecting personal information without consent.

  • Inciting or participating in prohibited activities.

The Platform reserves the right to investigate, remove violating content, or suspend or terminate accounts that violate these terms without prior notice.

Payments

  • The Platform reserves the right to add or remove payment methods at any time.

  • Electronic payments are processed through approved third-party service providers.

  • The Platform does not store any bank card information.

  • The Platform is responsible for handling refunds and cancellations in accordance with these terms.

Cancellation

The Platform may cancel any order if the product is unavailable or due to circumstances beyond control or outside the coverage area.

Amendments

The Platform reserves the right to modify or update these terms at any time by publishing the updated version on the Platform. Continued use of the Platform after such modifications constitutes implicit acceptance of the new terms.

Second: Terms for Opening a Store on the Platform and Pricing/Commission

A) Store Opening Requirements

  • Possession of a valid commercial registration or freelance license.

  • Compliance with e-commerce regulations and the Platform’s policies.

B) Pricing and Commissions

  • Abayti Platform receives 12% of the product value, and the amount is transferred to the merchant’s bank account within one week of delivery confirmation.

  • All transactions are conducted in Saudi Riyals. If the merchant’s bank account is outside Saudi Arabia, transfer fees will be deducted.

By using this Platform, you acknowledge that you have read, understood, and agreed to all the above terms and conditions and commit to full compliance with them.
