1. Terms of Use

These Terms of Use govern your use of our website abayti.app (“Website”) and our mobile applications “Abayti” and “Abayti Vendors” (“App”). Collectively, the Website and App are referred to as the “Platform.” Please read these terms carefully before use. If you do not agree to these terms, you are not permitted to use the services available on the Platform or Apps, and you must uninstall them, in accordance with the contract terms of the Abayti Platform/App.

If you enter into a contract with the Abayti Platform and agree to the contract terms in line with the foundational regulations of the Ministry of Commerce in the Kingdom of Saudi Arabia, you are entitled to benefit from all services and policies (such as the cancellation policy, refund policy, privacy policy, etc.) effective from the date of your registration and subscription to the Platform/App.

The Abayti Platform/App may be used by:

Individuals who are 18 years or older.
Legal entities (companies or establishments).

Use of the Platform and Services

Commercial/contractual terms (e.g., price, taxes, shipping costs, payment methods and terms, delivery schedule and method, product warranties, and after-sales services) are agreed upon solely between the buyer and the seller. The Abayti Platform/App operates the e-commerce platform as an intermediary between buyers and sellers and has no authority to intervene in or assume ownership of any transaction between them.

Abayti may provide technical support services to merchants related to order fulfillment, payment collection, customer service, and other services under separate agreements with merchants.
The Abayti Platform/App is not responsible for any failure to perform or breach of contracts entered into between buyers and sellers on the platform. It is not liable for unsatisfactory services, non-performance, damages, delays caused by out-of-stock products, or product unavailability.
The Abayti Platform/App is not responsible for the quality of products listed or for whether they meet buyers’ expectations; this responsibility rests entirely with the merchant.
Product details (design, material, price, etc.) are based solely on information provided by merchants. Merchants are fully responsible for all product images and data they submit, and Abayti is not liable for any discrepancies or inaccuracies.

Personal Information You Provide

If you wish to join the Abayti Platform/App (as a merchant or buyer), you must:

Create an account on the website/app.
Provide personal identification details (first and last name).
Provide contact details (mobile phone number, email address).
Provide demographic information (country, city, postal code).
You may add additional optional details to your profile. Apart from the basic information required to create your account, you decide how much you wish to share. We encourage you to carefully consider what you share and protect your identity and sensitive information. You may review or edit your profile at any time.
Provide bank information (bank name, account number, bank country), which is required from merchants.

Information Required from Buyers:
When making a payment, you will be asked to provide your card details at checkout through the payment gateway. By proceeding, you agree to provide accurate card information.

Your data will not be shared with third parties except as required for fraud prevention, by law, regulations, or court order. You are solely responsible for the security and confidentiality of your card details.

As a buyer, you understand that estimated delivery times are approximate and may vary. The Abayti Platform/App is not responsible for delays caused by the seller’s order processing or other unavoidable circumstances. Orders will only be delivered to the address you specified during checkout.

Abayti reserves the right to cancel your order at its discretion if the delivery address changes, with no refund entitlement. Delivery location changes are subject to additional charges if necessary.

You must provide accurate delivery instructions, authorization, and access. If delivery fails because of your failure to provide correct information or authorization, your order will be considered delivered, and all associated risks and responsibilities will transfer to you. No refunds will be issued in such cases, and our decision will be final.

You must select a delivery address during checkout. If you fail to select a shipping option, the seller may cancel your order. You may only use cards legally in your possession for transactions.

The Abayti Platform/App explicitly disclaims liability for unauthorized card use. Services will only be provided during merchants’ working hours.
Prohibited Activities on the Platform (For Merchants)

Below is a partial list of illegal or prohibited activities on the platform. Abayti reserves the right to investigate and take legal action, at its sole discretion, against anyone engaged in any prohibited activities, including but not limited to:

Using the website for any unlawful purpose or in violation of regulations.
Posting content that infringes intellectual property, privacy, publicity, trade secrets, or other rights of any party.
Posting illegal, obscene, defamatory, threatening, harassing, abusive, hateful, or embarrassing content, as determined by Abayti at its discretion or according to local community standards.
Posting content that constitutes cyberbullying, as determined by Abayti.
Posting content depicting dangerous, life-threatening, or risky behavior.
Posting phone numbers, home addresses, or last names of individuals.
Posting URLs to external websites, HTML code, or programming scripts.
Posting anything considered “spam” by Abayti.
Impersonating another person when posting content.
Collecting or harvesting information about others, including email addresses, without their consent.
Allowing another person or entity to use your identity to post or view comments.
Harassing, threatening, stalking, or abusing any person.
Engaging in any conduct that restricts or inhibits others from using or enjoying the platform, or that exposes Abayti, its clients, suppliers, or third parties to any liability or harm.
Encouraging others to engage in prohibited activities.

Abayti reserves the right, but is not obligated, to:

Investigate complaints that content violates the Terms of Use and remove or request removal of such content.
Remove offensive, illegal, disruptive, or non-compliant content.
Terminate user access to the platform for violations of the Terms of Use.
Monitor, edit, or disclose content on the platform.
Edit or delete any content posted on the platform, regardless of whether it violates these terms.

Modifications

Abayti reserves the right to modify or amend these terms (including policies referenced herein) at any time by posting updates on the platform. You are strongly encouraged to review these terms regularly. Continued use of the platform after updates are posted constitutes acceptance of the revised terms.
Payment

Abayti reserves the right to introduce new payment methods or remove existing ones at its discretion. If you choose to pay online, your payment will be processed by a third-party payment service provider. With your consent, your card or payment information may be securely stored by the payment provider for future orders.

Abayti does not store your card or payment details. You are responsible for ensuring sufficient funds are available to complete payment. Abayti assumes responsibility for payments, refunds, chargebacks, cancellations, and dispute resolution, as long as these matters are reasonable, justified, and in line with these terms.
Cancellation

Abayti reserves the right to cancel any order at any time due to product unavailability, delivery restrictions, or other unavoidable circumstances.
